TP/3577/2024 (E-filing) Mr. Sumit Vhanbatte, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. In this matter, office has raised objection as regards the Adoption Deed dated 17.12.1991. Hence, Advocate moved praecipe before the Hon'ble Court for dispensation of objection as regards adoption deed. Accordingly, Petitioner was directed to file Affidavit in this regard. Petitioner has filed Affidavit dated 14.01.2025 clarifying the position of Adoption Deed of petitioner. Upon perusal of the said Affidavit, this Hon'ble Court by an order dated 05.03.2025 has dispensed with the objection as regards the adoption of petitioner therefore, this petition may be proceeded with.

2. This petition is for Succession Certificate in respect of certain debts and securities belonging to deceased filed by petitioner namely Surendra Sambhaji Raghav being adopted son of deceased. Deceased namely Sambhaji Krishna Raghav died intestate at Ratnagiri on 07.10.2006. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Pancard is already annexed to the petition.

2. Ld. Advocate for petitioner submits that parents of deceased predeceased the deceased. Wife of deceased died on 12.08.2023. Deceased was survived by one son only who is petitioner herein. Petitioner is adopted son of deceased and para No. 6 of the petition refers the facts that the petitioner is adopted child of deceased. Petitioner is adopted legally in accordance with Adoption Deed datd 17.12.1991. There are no other legal heirs.

3. Petitioner's oath is filed. Affidavit of Service of affixation of General Notice dated 14.08.2024. Since the petitioner is sole surviving legal heirs there is not required to file Administration Bond. Delay is explained. All other legal formalities are complied with. Hence, petition is granted.
