Heard Ld. Advocate for petitioner. Ld. Advocate for petitioner to comply with the requisitions raised are as under :

1) To explain the legal heirs as per Rule 397 of the Bombay High Court (Original Side) Rules, 1980.

2) To file Affidavit of Attesting Witness as per Rule 383 of the Bombay High Court (Original Side) Rules, 1980.

3) In para No. 4 of the Will, there are beneficiaries namely Dr. Anselm and Anita D'silva. Hence, consent Affidavits of the said beneficiaries are required to be filed.

4) As per Will, there are directions for donations. Hence, same is required to be complied with.

5) As per Will, there is averment about sister of deceased namely Lucy Freitas. Hence, there is no averment pertains to the same in para No. 5 of the petition.

At the request of Ld. Advocate for petitioner, matter is adjourned till 22.11.2024 for compliance of aforesaid requisitions.
