TP/3671/2024 (E-filing) Ms. Sweta Moghe, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Janhavi Jagannath Naik being daughter and sole Executrix named under the Will of deceased. Deceased namely Shreedhar Jagannath Satam said to have died at Mumbai on 23.07.2023. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.

2. Ld. Advocate for petitioner submits that deceased left behind his last Will and Testament which was duly executed and registered with the office of Inspector General of Registration, Sub-Registrar, Mumbai City-3 on 07.02.2023. The said Will is in English language.

3. Ld. Advocate for petitioner submits that father and wife of deceased predeceased the deceased. Deceased was survived by widow, two sons and one daughter. Out of them married daughter is petitioner herein. Elder son of deceased namely Umesh Shreedhar Satam and mother of deceased namely Sumitra J. Satam have been served through the office of Sheriff and Affidavit of Service dated 27.11.2024 to that effect is filed. Another son namely Mahesh Shreedhar Satam has given his consent in favour of the petitioner. Consent Affidavit is on record. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavits of Neha Pramod Sawant and Shilpa Satish Bhuvad dated 07.05.2024 and 04.05.2024 both the Attesting Witnesses to the Will are filed. Affidavit of Service of General Citation dated 14.08.2024 is filed. All other legal formalities are complied with. Hence, petition is granted.
