1. Ld. advocate for the petitioner submits that the locker was held by the deceased with petitioner and another one, namely Shobha Suresh Jumani. After the death of the said deceased, the petitioner has an access to the said locker being survivor locker holder along with other one Shobha Suresh Jumani. Hence, there is no need to mention the locker in the schedule-I of the Petition.
2. Ld. advocate for the petitioner submits that other legal heirs are consented to delete the locker from the schedule-I of the petition. Ld. advocate of the petitioner has produced the Banks Letter stating that the said locker was held by the deceased along with the petitioner and other one(Shobha Suresh Jumani) and is being operational by either or survivor of them.
3. Considering this submission, praecipe is allowed subject to condition that before amending the petition the petitioner shall file consent affidavits of all legal heirs for deleting the locker from the Schedule-I of the petition. Petitioner to explain the contents of locker, belonging to the deceased, and reasons for the same, on oath. Furthermore, it is made clear that if any of the legal heirs is not giving the consent, as said aforesaid, the petitioner to take steps for inventory of the locker. Furthermore, the petitioner to made details averment in the petition for deleting the locker from the schedule-I of the petition.
4. Amendment to be carried out within 03 weeks from the date of uploading this order, if the petition is pending. Amended petition to be uploaded within 05 days from the date of amendment.
