1. Petitioner to comply issuance of Notice to Collector as per the Rule 396 and file affidavit of service for affixation of general citation as per the Rule 397 of the Bombay High Court (O. S.) Rules, 1980.

2. It appears that upon issuance of the citation on 20.08.2024 it was sealed and on 03.09.2024 04.02.2025 Officer on Special Duty, with Testamentary Department

3. Ld. Advocate for the petitioner latter-on moved a praecipe dated 04.02.2025 and thereby submits that vide an order dated 07.08.2024, specific citation to the nonconsenting legal heirs, namely Ashwini Ashok Narvekar and Shrikant Vsanat Bandivadekar was issued and it was sealed on 04.09.2024. However, upon receipt of the said citation, the Ld. Advocate for the petitioner corrected the residential address of the legal No. 6, namely Shrikant Vsanat Bandivadekar. He further submits that, he did that correction, however, it was his bonafide mistake and noting intentional act is done.

4. Ld. Advocate for the petitioner submits that fresh citation may be issued to these legal heirs and he will take the steps accordingly.

5. As the petitioner has amended the residential addresses of these two non-consenting legal heirs on 04.02.2025. Amended petition is available in the CIS. Hence, the office to issue fresh citation to these two non-consenting legal heirs, at their new address. Ld. Advocate to take steps accordingly.
