Heard the learned counsel for the parties.

The learned counsel for the petitioner submits that the beneficiary under the Will are not the legal heirs. All the legal heirs, of the deceased, the particulars of whom furnished in paragraph 8 of the petition, have filed affidavits giving their consent for the grant of Letters of Administration with Will annexed. 3.
