1. Perused Petition. Heard Ld. Advocate for petitioners. This petition is for Probate of last Will and Testament of deceased filed by petitioners namely Sajjan Jhunjhunwala and Amritlal Gupta being Executors named under the Will of deceased. The deceased namely Gopikrishna Rungta died at Mumbai on 19.02.2001. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Pan Card is annexed to the petition.

2. The deceased left behind his last Will and Testament which was duly executed at Mumbai on 06.02.1986. The said Will is in English language. The Para No. 1 of the Will refers to the appointment of Executors. Only three Executors appointed under the Will. Two executors are petitioners herein and remaining executrix namely Rajdulari Gopikrishna Rungta died on 28.08.2016 and her death certificate is annexed to the petition as Exhibit - "E". Residuary clause in respect of properties of deceased is mentioned at para Nos. 6 and 7(b) of the Will.

3. Ld. Advocate for petitioner submits that parents of deceased predeceased the deceased. Widow of deceased since deceased the deceased. Deceased had four daughters. Out of them one daughter namely Aruna died leaving behind her one son and one daughter. Another daughter of deceased namely Sunanda died leaving behind one son. Deceased was survived by two daughters, two grandsons and one granddaughter. Out of them both the daughters have have given their consents in favour of the petitioner herein. Consent Affidavits are on record. Two grandsons and one granddaughter have been served with the citation through the office of Sheriff, Mumbai and Affidavit dated 28.11.2025 is filed to that effect. There are no other legal heirs.

4. Petitioner's oath is filed. As the original Attesting Witnesses have expired, therefore, petitioner has filed Affidavit of Kamlesh Chokhani dated 20.12.2025 and the same is accepted as per Rule 384 of the Bombay High Court (Original Side) Rules, 1980. Affidavit of Service of General Citation dated 20.11.2025 is filed. Delay is explained and the same is condoned. All other legal formalities are complied with. Hence, petition is granted.

5. Office to issue Probate as prayed after verifying whether any cross petition is filed or whether any caveat is filed.
