1. Perused Petition which is filed online. Heard Ld. Advocate for the Petitioner. This Petition is for Probate of Last Will and Testament of the deceased filed by the Petitioner Satish Lachhmandass Kochhar, being one of the Executors named under the Will of the deceased. Deceased Meera Satish Kochhar, said to have died at Mumbai on 22.01.2024. Copy of death certificate is annexed to the Petition. For identification proof of the deceased, copy of Aadhar Card is annexed to the Petition.

2. Mr. Vaishya, Advocate for the Petitioner submits that deceased left behind her last Will and Testament which was duly executed at Mumbai on 20.09.2017. The said Will is in English language.

3. Mr. Vaishya, Advocate for the Petitioner submits that deceased was governed under the Hindu Succession Act 1956. It is submitted that the parents of the deceased pre-deceased the deceased. The Deceased has her husband, a son and a daughter. Save and except as mentioned in para - 11, there are no other legal heirs left by the deceased.

4. Petitioner's Oath are filed. The other Executors, Mr. Deepak Bhalla, Executor No.1, Mr. Vishesh Satish Kochhar being Executor

) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) No.3 and Mrs. Prerna Dharmesh Datta being Executor No.4, have filed their renouncing Affidavits dated 04.07.2024, 02.07.2024 and 02.07.2024 respectively. The Ld. Advocate for the Petitioner to correct prayer clause by mentioning the renouncing rights of other three Executors within three days from the date of uploading of the order. Consent Affidavits of son and married daughter of the deceased as mentioned in para - 11 are on record. Affidavits of Harsh Mohan and Manoj D. Mehta, both the attesting witnesses to the Will are filed. Affidavit of service of General Citation is filed. All the Affidavits are also filed online. All other legal formalities are complied with. Hence, Petition is granted.

5. Office to issue Probate as prayed after verifying whether any Cross Petition or Caveat is filed.
