This petition is for Succession Certificate in respect of certain securities belonging to deceased filed by petitioner namely David Harish Mayadas being son of deceased. Deceased namely John Anand Sarup Mayadas died intestate at Australia on 19.08.2017. Copy of death certificate is annexed to the petition. Petitioner has filed Affidavit dated 02.04.2024 for dispensation of identification proof of deceased.
2. Ld. Advocate for petitioner submits that parents of deceased predeceased the deceased. Deceased was married to Moira Mayadas who died on 12.03.1987. From the first marriage, deceased had two sons and two daughters. Daughter of deceased namely Meera Korte was married and divorced at the time of her death and she had no children. One son is petitioner herein and another daughter has given her consent in favour of petitioner. Consent Affidavits are on record. Deceased thereafter married to Georgina Beryl Mayadas and no children from this wedlock. The other legal heirs namely John Gordon Mayadas and second wife has been served through newspaper publication and Affidavit dated 14.12.2024 is filed to that effect. There are no other legal heirs.
3. Petitioner's oath is filed. Affidavit of Service of affixation of General Notice dated 20.09.2024 and Administration Bond dated 03.10.2024 filed. Delay is explained and the same is condoned.
4. As per order dated 17.03.2025, Ld. Advocate for petitioner has carried out corrections in the cause title of the petition only. Hence, petitioner is required to correct all other titles of the petition and take steps to take necessary updation in the CIS system. Also, require to file Petitioner's Oath and not through the Power of Attorney.
5. Ld. Advocate for petitioner file praecipe to place on board as and when all compliance is done in this matter. Remove from board. 28.04.2025 COMPANY REGISTRAR / TESTAMENTARY REGISTRAR
