The petition is filed in respect of the properties of the deceased No. 1 and No.2. The subject property of this petition is owned by the deceased No. 1 and 2. The said property is situated within local limits of Navi Mumbai, District-Thane. The petitioner No.1's fixed place of abode was within Mumbai. Hence, as per Sec. 270 of the Indian Succession Act, 1925(for short "IS Act"), this Court has jurisdiction to entertain the petition in respect of the deceased No. 1. However, the deceased No.2's fixed place of abode is within local limit of Navi Mumbai, District Thane. Hence, it is to determine that to entertain the petition in respect of the deceased No.2, whether this court has a Jurisdiction vide Sec. 270 of the IS Act. Hence, adjourned.
