TP/4079/2024 (E-filing) Mr. Jayant Wani, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Rupesh Tushar Dhara being sole Executor named under the Will of deceased. The deceased namely Tushar Rangalal Dhara died at Mumbai on 13.03.2023. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.

2. The deceased left behind his last Will and Testament which was duly executed at Mumbai on 20.12.2022. The said Will is in English language. The Para No. 4 of the Will refers to the appointment of Executor. Only one Executor appointed under the Will who is petitioner.

3. Ld. Advocate for petitioner submits that deceased was survived by mother, widow and one son . Out of them son is petitioner herein and widow has given her consent in favour of the petitioner. Consent Affidavit is on record. Mother of deceased has been served through citation and Affidavit of Service of Citation dated 04.10.2024 is filed to that effect. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Tapas Manik dated 27.09.2023 one of the Attesting Witness to the Will is filed. Affidavit of Service of General Citation is not filed.

5. Ld. Advocate for petitioner file praecipe to place on board as and when the matter is ready for final grant. Hence, remove from board. 11.07.2025 COMPANY REGISTRAR / TESTAMENTARY REGISTRAR
