TP/4115/2024 (E-filing) Ms. Sana Khan, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioners namely Margaret Wong Shroff, Michelle Naik and Asif Mushtaq Naik being Executors named under the Will of deceased. The deceased namely Dorethea Kumping Leo died at Mumbai on 22.02.2024. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.

2. The deceased left behind her last Will and Testament which was duly executed at Mumbai on 27.06.2016. The said Will is in English language. The Para No. 2 of the Will refers to the appointment of Executors. Only three Executors appointed under the Will who are petitioners herein.

3. Ld. Advocate for petitioner submits that husband of deceased died on 26.05.2016. Daughter of deceased namely Maureen Leo died on 17.12.1981 as spinster. Deceased was survived by one son namely David Leo and his whereabouts are not known hence, Advocate to take steps for service of citation upon him.

4. Petitioner's oath is filed. Affidavit of Bhairavi Niranjan Pathak dated 04.05.2024 and Dr. Mustafa Moiz Skarwala dated 01.05.2025 both the Attesting Witnesses to the Will are filed. Affidavit of Service of General Citation dated 17.01.2025 is filed.
