Heard the learned Counsel for the petitioner. 2.

This petition is moved before this Court to accept the affidavits of the witness in proof of the Will under Rule 384 of the Bombay High Court (Original Side) Rules, 1980. 3.

The petition for Letters of Administration with Will annexed is filed for grant in respect of Meenakshi Narayanan Nambiar (the deceased). Mr. K. Ramchandran Iyer and Dr. Trymbak Vaman Garud were the attesting witnesses. Both the attesting witnesses have passed away. Copies of death certificates of Mr. K. Ramchandran Iyer and Dr. Trymbak Vaman Garud are annexed at Exhibits-A and B.

Mr. Harikrishnan Madhavan Nambiar, who is the sonin-law of the deceased, has affirmed that he was present at the time of the execution of the Will by the testatrix. The testatrix had put her signature on the Will in the presence of the above named attesting witnesses and, on the instructions of the testatrix, the attesting witnesses had also signed the Will in his presence. There are adequate averments in the affidavit of Mr. Harikrishnan Madhavan Nambiar in proof of the Will in accordance with Rule 384 of the Bombay High Court (Original Side) Rules.
