1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Sudesh Sadashiv Mastekar being sole Executor named under the Will of deceased. The deceased namely Mahadeo Jayram Mastekar died at Mumbai on 20.02.2023. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.

2. The deceased left behind his last Will and Testament which was duly executed at Mumbai on 30.10.2018. The said Will is in English language. The Para No. 2 of the Will refers to the appointment of Executor. Only one Executor appointed under the Will who is petitioner herein. The property mentioned in the Schedule has referred in para No. 4 of the Will.

3. Ld. Advocate for petitioner submits that parents and wife of deceased predeceased the deceased. Deceased died issue-less. One brother of deceased namely Ramchandra died leaving behind his widow, one daughter and two sons. Deceased was survived by two brothers, one sister, one sister-in-law, one niece and two nephews. The citation has been served through the office of Sheriff, Mumbai upon two brothers, one sister-in-law, one niece and two nephews and Affidavit of Service of Citation dated 14.11.2024 is filed. Sister of deceased has been served the citation through office of Sheriff, Mumbai and Affidavit dated 03.01.2026 is filed to that effect. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Tejas Eknath Shengade dated 11.07.2024 one of the Attesting Witness to the Will is filed. Affidavit of Service of General Citation dated 19.09.2024 is filed. All other legal formalities are complied with. Hence, petition is granted.

5. Office to issue Probate as prayed after verifying whether any cross petition is filed or whether any caveat is filed.
