TP/4168/2024 (E-filing) Mr. Jayant Wani i/b. Lakdwala and Co., Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Anusaya Madhusudan Chandan being sole Executrix named under the Will of deceased. Deceased namely Madhusudan Mulji Chandan alias Madhusudan M. Chandan said to have died at Mumbai on 24.03.2024. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.

2. Ld. Advocate for petitioner submits that deceased left behind his last Will and Testament which was duly executed at Mumbai on 23.08.2023. The said Will is in English language.

3. Ld. Advocate for petitioner submits that mother of deceased predeceased the deceased. Deceased was survived by widow, one son and one daughter. Out of them widow is petitioner herein and son has given his consent in favour of the petitioner. Consent Affidavit is on record. As regards married daughter of deceased, Affidavit of Service of citation dated 09.01.2025 is filed through the Deputy Sheriff from the office of Sheriff, Mumbai. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit and Additional Affidavit of Dr. Shailesh Gordhandas Khakhar dated 15.05.2021 one of the Attesting Witness to the Will is filed. Affidavit of Service of General Citation dated 18.09.2024 is filed. All other legal formalities are complied with. Hence, petition is granted.
