The petitioner to file affidavit of the attesting witness/s in prescribe form No. 102 of the the Bombay High Court (OS) Rules, 1980. 2.
If attesting witnesses is not available then, the petitioner to comply the rule 384 of the the Bombay High Court (OS) Rules, 1980 as per the direction given in the Testamentary Petition No. 50 of 2011, by making necessary averment to accept the affidavit and to prove the fact that the attesting witnesses are not available, for the reasons known to him. Furthermore, the petitioner to take steps to secure the presence of the attesting witnesses.

Petitioner to carry out an amendment withing period of 03 weeks from the date of uploading this order, if the petition is pending. Consequential amendment, if any, stands allowed.
