TP/4190/2024 (E-filing) Ms. Raksha Tanna, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Mahesh Goverdhan Palekar being sole Executor named under the Will of deceased. The deceased namely Balkrishna Dinanath Palekar died at Mumbai on 06.12.2023. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.

2. The deceased left behind his last Will and Testament which was duly executed at Mumbai on 12.04.2022. The said Will is in English language. The Para No. 11 of the Will refers to the appointment of Executor. Only one Executor appointed under the Will.

3. Ld. Advocate for petitioner submits that parents and wife of deceased predeceased the deceased. Deceased died issue-less. Deceased had three brothers and seven sisters who all have expired and their legal heirs are mentioned in para No. 10 of the petition. Out of them five legal heirs have given their consents in favour of the petitioner. Consent Affidavits are on record. Rest of all the legal heirs have been served the citation through the office of Sheriff, Mumbai and Affidavit dated 03.01.2025 to that effect is filed. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Mandar Patki dated 14.05.2024 one of the Attesting Witness to the Will is filed. Affidavit of Service of General Citation dated 21.09.2024 is filed. All other legal formalities are complied with. Hence, petition is granted.
