TP/4218/2024 with WILL/1676/2024 Mr. Jayant Wani i/b. Kajal Mahimtura, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. Upon perusal of the Will, it has been observed that on the Will two Attesting Witnesses namely Madhu Sethi and Rajesh Bijlani signed as Attesting Witnesses to the said Will. At the time of registration of the Will, Sameer Nabi Shaikh and Mohit Nandlal Yadav signed as Witnesses before the Registrar. It is further observed that in para No. 2 of the Affidavit of Attesting Witness namely Madhu Sethi, it has been mentioned that they both were present together at the office of the SubRegistrar of Assurances, Andheri and saw the deceased added her signature at the foot of page Nos. 1 and 2 of the Will.

2. In view of the above, Ld. Advocate for petitioner to explain why the Attesting Witnesses did not signed at the time of registration of the Will dated 26.10.2021 before the Registrar and why their presence is not recorded before the Registrar and how Mr. Sameer Nabi Shaikh and Mr. Mohit Nandlal Yadav signed as Witnesses before the Registrar and not Madhu Sethi and Rajesh Bijlani.

3. List the matter on 03.01.2025.
