TP/4298/2024 (E-filing) Mr. Jayesh Kotadiya i/b. Sandhya Yadav, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Kamlesh Ramanlal Doshi being sole Executor named under the Will of deceased. The deceased namely Ramanlal Himatlal Doshi died at Mumbai on 24.03.2011. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Pan Card is annexed to the petition.

2. The deceased left behind his last Will and Testament which was duly executed at Mumbai on 12.12.2009. The said Will is in English language. The Para No. 2 of the Will refers to the appointment of Executor. Only one Executor appointed under the Will who is petitioner herein.

3. Ld. Advocate for petitioner submits that parents of deceased predeceased the deceased. Wife of deceased since deceased the deceased. Deceased was survived by one son and three daughters. Out of them son is petitioner herein and two daughters have given their consents in favour of the petitioner. Consent Affidavits are on record. Remaining daughter namely Lina Janak Muni has not filed her consent Affidavit. Hence, Advocate take steps.

4. Petitioner's oath is filed. Affidavits of Esmail Abdeally Amranwala and Vasantlal Nyalchand Sanghavi dated 07.05.2024 both the Attesting Witnesses to the Will are filed. Affidavit of Service of General Citation dated 26.09.2024 is filed. Delay is explained and the same is condoned.

5. Ld. Advocate for petitioner file praecipe to place on board as and when the matter is ready for final grant. Hence, remove from board. 09.07.2025 COMPANY REGISTRAR / TESTAMENTARY REGISTRAR
