1. Perused Petition which is filed online. Heard Ld. Advocate for the Petitioner. This Petition is for Probate of Last Will and Testament of the deceased filed by the Petitioner Rajesh Thadani Son of Narain Thadani being the sole Executor named under the Will of the deceased. Deceased Sheila Thadani alias Sheila N. Thadani alias Sheila wife of Narain Thadani alias Sheila Thadani wife of Narain Dass alias Sheila Thadhani wife of Narain Thanwardas Thadhani alias Sheila wife of Bhanupratap Singh Chauhan alias Sheila Shahani alias Sheila Thadani daughter of Motiram G Shahani, said to have died at Delhi on 05.07.2024. Copy of Death Certificate is annexed to the Petition. Copy of Aadhaar Card of the deceased as ID Proof is annexed to the petition.
2. Mr. Lakdawala, Advocate for the Petitioner submits that deceased left behind her last Will and Testament which was duly executed and registered at Mumbai on 24.05.2019. The said Will is in English language.

Mr. Lakdawala, Advocate for the Petitioner submits that deceased was governed under the Hindu Succession Act, 1956. It is submitted that the deceased died living behind only son. Deceased during her lifetime first got married to Narayan P. Thadani died on 17.11.1984. The said deceased had no daughter and only one son on the said wedlock. Then deceased got remarried to Bhanupratap Singh Chauhan to died on 07.12.2022. Exh. D to the petition is a copy of his death certificate he had no issue from the said wedlock both predceceased the deceased. Parents of deceased and parents of husband of deceased predeceased the deceased. Save and except as mentioned in para -8, there are no other legal heirs and next of kin left by the deceased.
4. Petitioner's Oath is filed. Affidavit of Kapilendu Advani, one of the attesting witness to the Will is filed. Affidavit of service of General Citation is filed. All Affidavits are filed online. All other legal formalities are complied with. Hence, Petition is granted.
5. Office to issue Probate as prayed after verifying whether any Cross Petition or Caveat is filed.
