TP/4325/2024 (E-filing) Mr. Jayant Wani i/b. Vinayak Shankar Palande, Advocate for Petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Succession Certificate in respect of certain securities belonging to deceased filed by petitioner namely Farida Kagalwala being granddaughter of deceased. Deceased namely Abedin Sharafally Bhagat died intestate at Mumbai on 04.11.1977. Copy of death certificate is annexed to the petition. Advocate for petitioner has filed Affidavit dated 25.11.2023 for dispensation of identification proof of deceased. The said Affidavit is accepted.

2. Ld. Advocate for petitioner submits that parents of deceased predeceased the deceaesd. Wife of deceased died on 16.07.2016. Daughter of deceased namely Asma Saifuddin Ravat died on 09.12.2019. Granddaughter of deceased namely Rashida died on 10.09.2010. Deceased was survived by one daughter and two granddaughters. Out of them one granddaughter is petitioner herein and all other legal heirs have given their consents in favour of petitioner. Consent Affidavits are on record. There are no other legal heirs.

3. Petitioner's oath is filed. Affidavit of Service of affixation of General Notice dated 04.10.2024 and Administration Bond dated 10.10.2024 are filed. Delay is explained and the same is condoned. All other legal formalities are complied with. Hence, petition is granted.
