The matter is on board today for issuance of a summons to the attesting witnesses of the Will of the deceased, of which Probate is sought for in the captioned Testamentary Petition.

Learned Counsel for the Petitioner has invited my attention to a copy of the Letter dated 7 th October 2024 addressed to both the attesting Mugdha

2 13-TP 4374-24@ Will 1742-24.doc witnesses. He places reliance upon the courier receipt and points out that despite service, the attesting witnesses have not been responded. It is thus he seeks issuance of a summons to the said attesting witnesses. 3.

Having heard Learned Counsel and having due regard to the submissions made, I am satisfied that the case has been made out for issuance of summons to the attesting witnesses.

Hence, issue summons to the attesting witnesses, returnable on th April 2025.
