1. Since December, 2024 Ld. Advocate Shri. Ganesh Gupta is appearing for the legal heirs namely Anuradha, a daughter in Law of the deceased and her children. However, no Vakalatnama is appeared to have been filed, till today. Even, Ld. Advocate, appearing today in the matter, submits that he is not aware about the proceedings and facts of filing of Vakalatnama. On the other Hand, Ld. advocate for the petitioner is objecting to hear the Ld. advocate in absence of the Vakalatnama and in absence of the appropriate proceeding. Submission is required to be accepted from the face of the record.

It appears that, since December, 2024 only dates are being sought by the Ld. Advocate without taking any steps. Therefore, in circumstances, where consent affidavits are filed as per the Rule 397 of the of the Bombay High Court ( O. S) Rules, 1980. I do not find any hurdle to proceed with the matter. 3.

Petitioner to file the administration bond for the gross amount as per form no. 118 r/w Rule 420 of the Bombay High Court ( O. S) Rules, 1980. Hence, adjourned.
