PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Sarjerao Baburao Gaikwad being sole Executor named under the Will of deceased. Deceased namely Akkatai Baburao Gaikwad said to have died at Sangli on 26.03.2019. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.

2. Ld. Advocate for petitioner submits that deceased left behind her last Will and Testament which was duly executed and registered at Mumbai on 28.11.2013 with the office of Joint Registrar, Mumbai City, Mumbai. The said Will is in English language.

3. Ld. Advocate for petitioner submits that parents and husband of deceased predeceased the deceased. Deceased was survived by three sons and two married daughters. Out of them son is petitioner herein and all other legal heirs have given their consents in favour of the petitioner. Consent Affidavits are on record. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Rajan Mayaji Rane dated 13.01.2024 one of the Attesting Witness to the Will is filed. Affidavit of Service upon legal heirs dated 07.11.2024 through the Bailiff from the office of Sheriff, Mumbai is filed. Affidavit of Service of General Citation dated 21.11.2024 is filed. All other legal formalities are complied with. Hence, petition is granted.
