1. Read praecipe dated 11.03.2025. I have gone through the proposed amendment. Petitioner is willing to delete the locker mentioned in the schedule of the property, however, as per the Section 278 of the Indian Succession Act, 1925, every property belonging to the deceased is required to be mentioned in the schedule along with its value.
2. Hence, unless petitioner produces document showing that as an today that locker does not belong to the deceased, such relief cannot be granted. Hence, except proposed amendment in para no. 7 as shown 7.3 and proposed amendment no. 3 (I) and 3(II) rest is allowed. Upon filing the additional affidavit of the petitioner confirming the amendment, re-verification is dispensed with.
3. Petitioner to carry out an amendment within three weeks from the date of uploading of this order, if petition is pending.
