TP/4498/2024 (E-filing) WITH WILL/1791/2024 Ms. Seema Hunnurkar, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Harish Shrikant Karnik being sole Executor named under the Will of deceased. Deceased namely Rameshchandra Gopinath Deshpande said to have died at Mumbai on 02.04.2024. Copy of death certificate is annexed to the petition. Copy of identification proof of deceased viz. Aadhaar Card is annexed to the petition.

2. Ld. Advocate for petitioner submits that deceased left behind his last Will and Testament which was duly executed and registered with the office of Sub-Registrar of Kurla, Mumbai Suburban District, Mumbai on 03.08.2021. The said Will is in Marathi language hence, Ld. Advocate for petitioner has filed Affidavit of petitioner dated 29.07.2024 for compliance of order dated 10.01.2024 passed by the Hon'ble Court in TP No. 1263 of 2023.

3. Ld. Advocate for petitioner submits that parents and wife of deceased predeceased the deceased. Deceased died issue-less. Deceased had no brother and was survived by two married daughters. Both the married daughters have given their consents in favour of the petitioner. Consent Affidavits are on record. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Milind Ramchandra Adhikari dated 18.07.2024 one of the Attesting Witness to the Will is filed. Affidavit of Service of General Citation dated 27.09.2024 is filed. All other legal formalities are complied with. Hence, petition is granted.
