1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Surinder Kaur Chhatwal being sole surviving Executor named under the Will of deceased. The deceased namely Harpreet Kaur Walia is said to have died at Mumbai on 21.03.2024. Copy of the death certificate is annexed to the petition. Identification proof of deceased viz. a copy of the Aadhaar Card is annexed to the petition.

2. The deceased left behind her last Will and Testament which was duly executed and registered at Mumbai on 12.12.2008. The said Will is in English language. The first line of page No. 2 of the Will refers to the appointment of Executor. Only two Executors appointed under the Will. Co-executor Jaspal Singh Chhatwal died on 18.03.2021.

3. Ld. Advocate for petitioner submits that deceased died as widow. Husband of the deceased died on 11.12.2003. Deceased had no son and was survived by one daughter who has given her consent in favour of the petitioner. Consent Affidavits are on record. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Suman Murarka dated 31.05.2024 one of the Attesting Witness to the Will is filed. Affidavit of Service of General Citation dated 13.11.2024 is filed. All other legal formalities are complied with. Hence, Petition is granted.
