1. Perused Petition. Heard Ld. Advocate for the Petitioner. This Petition is for Probate of Last Will and Testament and Codicil of the deceased filed by the Petitioner Jasmine Iqbal Singh being the sole Executrix named under the Will of the deceased. Deceased Ranjeet Kaur also Ranjeet Kaur Panesar said to have died at Mumbai on 02.08.2016.

Copy of Death Certificate is annexed to the Petition. Copy of Aadhaar Card of the deceased as ID Proof is annexed to the petition.

2. Ms. Rayate, Advocate for the Petitioner submits that deceased left behind him last Will and Testament and Codicil which was duly executed at Mumbai on 11.05.2006 and 12.09.2013 respectively. The said Will and Codicil is in English language.

3. Ms. Rayate, Advocate for the Petitioner submits that deceased was governed under the Hindu Succession Act, 1956. It is submitted that the husband of the deceased predeceased the deceased. Exh. E. to the Petition is a copy of his death certificate.

Exh. F. to the Petition is copy of death certificate of the deceased son of the deceased who expired on 23.12.2023. Save

) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) and except as mentioned in para -9, there are no other legal heirs and next of kin left by the deceased. The Ld. Adv. for the Petitioner submits that it took considerable time and effort to search the Will, which was not found. As such to compile the details of estate it took considerable time. It was only now the Petitioner was able to compile the details of the estate. Hence the delay if any in filing this Petition deserves to be condoned. Thus, the delay is explained.

4. Petitioner's Oath is filed. Consent Affidavits of two daughters, one grandson and one grand daughter of the deceased as mentioned in para 9 are on record. Affidavit of Deepak Chandanani and Khushru Patel one of the attesting witness to the Will and Codicil respectively is filed. Affidavit of service of General Citation is filed. All other legal formalities are complied with. Hence, Petition is granted.

5. Office to issue Probate as prayed after verifying whether any Cross Petition or Caveat is filed.
