TP/4616/2024 (E-filing) Ms. Preksha Shah i/b. Universal Legal, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of Photocopy last Will and Testament of deceased filed by petitioner namely Sachin Rajiv Banker being sole Executor named under the Will of deceased. The deceased namely Rajiv Dushyant Banker died at Philadelphia, USA on 01.03.2023. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Passport is annexed to the petition.

2. The deceased left behind his last Will and Testament which was duly executed at Philadelphia, USA on 24.09.2020. The said Will is in English language. The Page No. 2 of the Will refers to the appointment of Executor. Only one Executor appointed under the Will who is petitioner herein.

3. Ld. Advocate for petitioner submits that parents of deceased predeceased the deceased. As per par NO. 10 of the petition, deceased was divorcee. Deceased was survived by four sons. Out of them one son is petitioner herein and remaining three sons have given their consents in favour of the petitioner. Consent Affidavit are on record. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Hsihui Chang dated 28.08.2025 one of the Attesting Witnesses to the Will is filed. Affidavit of Service of General Citation dated 25.10.2024 is filed. All other legal formalities are complied with. Hence, petition is granted.
