TP/4618/2024 (E-filing) Mr. Pranav Khatkul i/b. Janu Gulati, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioners namely Prerak Shashin Thakkar and Shobha Shashin Thakkar being Executors named under the Will of deceased. The deceased namely Kirtida Ramanlal Thakkar died at Ahmedabad on 03.12.2023. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.

2. The deceased left behind her last Will and Testament which was duly executed at Gujarat on 15.09.2018. The said Will is in Gujarati language and official translation of the said Will is issued by the office of Chief Translator is uploaded separately through e-filing on the official portal of the Bombay High Court. The Para No. 8 of the Will refers to the appointment of Executors. Only two Executor appointed under the Will who are petitioners herein.

3. Ld. Advocate for petitioner submits that parents and husband of deceased predeceased the deceased. One son of deceaed namely Shashin predeceased the deceased leaving behind his widow, one son and one daughter. Deceased was survived by two daughters, one daughter-in-law, one grandson and one granddaughter. Out of them grandson and daughter-in-law are petitioners herein and the granddaughter and two daughters have given their consents in favour of the petitioner. Consent Affidavits are on record. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Krunal Rohit Shah dated 01.05.2024 one of the Attesting Witness to the Will is filed. Affidavit of Service of General Citation dated 29.06.2025 is filed. All other legal formalities are complied with. Hence, petition is granted.

5. Office to issue Probate as prayed after verifying whether any cross petition is filed or whether any caveat is filed.
