Affidavit of service is defective as citation is not affixed on the notice board of the Collector. Furthermore, citation is not annexed with the affidavit of service. Hence, petitioner to take steps. The petitioner to take steps to justify the surety to Administration Bond, in respect of the share of non-consenting Legal heirs of the deceased, namely Anneal and Anish, vide Rule 422 of the Bombay High Court (OS) Rules, 1980. Hence, the petition is adjourned for the steps. 2.

The petitioner to file affidavit in respect of pasting of citation on the notice board of the Collector and Notice Board of the Hon'ble High Court, vide Rule 397 of the Bombay High Court (OS) Rules, 1980 (For short "BHC Rules"). 3.

The petitioner to file the consent of the legal heir/s, namely Anneal and Anish, or take steps to serve the citation vide Rule 397 of Bombay High Court (OS) Rules, 1980.
