TP/4732/2024 (E-filing) Mr. Jinay Jain i/b. Jani and Parikh, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioners namely Jayveerendrasinh Digveerendrasinh Solanki, Amarendrasinh Digveerendrasinh Solanki and Divyabhanusinh Sajjansinhji Chavda being Executors named under the Will of deceased. The deceased namely Digveerendrasinh Indrasinhji Solanki died at Gujarat on 13.11.2018. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Pan Card is annexed to the petition.

2. The deceased left behind his last Will and Testament which was duly executed at Mumbai on 28.04.2011. The said Will is in English language. The Para No. 1 of the Will refers to the appointment of Executor. Only three Executors appointed under the Will and out of them first two executors are petitioners No. 1 and 2 herein. Third executor appointed under the Will is Chattered Account namely H. B. Jokhakar. As stated in para No. 2 of the said Affidavit dated 12.07.2025, it is mentioned therein that the said Jokhakar has expired on 11.04.2025 hence, petitioner No. 3 is alternate executor appointed under the Will.

3. Ld. Advocate for petitioner submits that parents and wife of deceased predeceased the deceased. Deceased was survived by two sons who are petitioner Nos. 1 and 2 herein. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Rashmi Jokhakar dated 26.06.2024 one of the Attesting Witness to the Will is filed. Affidavit of Service of General Citation dated 14.11.2024 is filed. All other legal formalities are complied with. Hence, petition is granted.
