TP/4758/2024 (E-filing) Mr. Jayesh Mestry, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of photocopy of last Will and Testament of deceased filed by petitioner namely Umesh Keshavdeo Ganeriwala being one of the Executors named under the Will of deceased. The deceased namely Keshavdeo Ramdutt Ganeriwala died at Mumbai on 27.04.1995. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Pan Card is annexed to the petition.

2. The deceased left behind his last Will and Testament which was duly executed at Mumbai on 13.02.1995. The said Will is in English language. The Para No. 2 of the Will refers to the appointment of Executors. Only two Executors appointed under the Will. Petitioner is one of the executors and another executor namely Harish Keshavdeo Ganeriwala died on 21.08.2012 and copy of death certificate is annexed to the petition as Exhibit - "D".

3. Ld. Advocate for petitioner submits that parents and wife of deceased predeceased the deceased. Deceased had two sons and four daughters. One son of deceased namely Harish died on 21.08.2012 leaving behind his two sons. One daughter of deceased namely Padma died on 26.01.2022 leaving behind one son and three daughters. Deceased was survived by one son, three daughters, three grandsons and three granddaughters. Out of them son is petitioner herein and all the other legal heirs have given their consents in favour of petitioner herein. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Subhash Chandra Jalan dated 05.08.2024 one of the Attesting Witness to the Will is filed. Affidavit of Service of General Citation dated 22.10.2024 is filed. All other legal formalities are complied with. Hence, petition is granted.
