TP/4758/2024 (E-filing) Mr. Jayesh Mestry, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of photocopy of last Will and Testament of deceased filed by petitioner namely Umesh Keshavdeo Ganeriwala being one of the Executors named under the Will of deceased. The deceased namely Keshavdeo Ramdutt Ganeriwala died at Mumbai on 27.04.1995. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Pan Card is annexed to the petition.

2. The deceased left behind his last Will and Testament which was duly executed at Mumbai on 13.02.1995. The said Will is in English language. The Para No. 2 of the Will refers to the appointment of Executors. Only two Executors appointed under the Will. Petitioner is one of the executors and another executor namely Harish Keshavdeo Ganeriwala died on 21.08.2012 and copy of death certificate is annexed to the petition as Exhibit - "D".

3. Petitioner's oath is filed. Affidavit of Subhash Chandra Jalan dated 05.08.2024 one of the Attesting Witness to the Will is filed. Affidavit of Service of General Citation dated 22.10.2024 is filed.

4. Ld. Advocate for petitioner seeks leave to amend the table of para No. 7 of the petition and para No. 7 of the petition. Leave is granted. Ld. Advocate for petitioner to carry out amendment within twelve weeks from the date of uploading of this order. Ld. Advocate for petitioner re-upload the amended petition on the official portal of the Bombay High Court.
