This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Sangeetha Rai w/o. Vijay Nath Rai being one of the Executrix named under the Will of deceased. The deceased namely Amy Bomie Bomanji died at Mumbai on 27.04.2020. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.

2. The deceased left behind her last Will and Testament which was duly executed at Mumbai on 13.05.2019 and the same was registered on 14.05.2019 at Joint Sub-Registrar, Mumbai City-IV. The said Will is in English language. Petitioner is one of the Executors and another executor namely Vijay Nath Rai has renounced his rights for Probate and execution of the Will of deceased and Affidavit dated 27.12.2024 is filed to that effect.

3. Ld. Advocate for petitioner submits that parents of husband of deceased and husband of deceased predeceased the deceased. Deceased died issue-less. Deceased had no brother-in-law and sister-in-laws. Deceased had no brother and had one sister namely Zarin Sukumaran who died on 02.02.2024, leavign behind two daughters and one son. Deceased was survived by two married nieces and one nephew. Out of them one married niece is petitioner herein and all other legal heirs have given their consents in favour of the petitioner. Consent Affidavits are on record. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of P. K. Valsan dated 19.03.2024 one of the Attesting Witness to the Will is filed. Affidavit of Service of General Citation dated 21.10.2023 is filed. All other legal formalities are complied with. Hence, petition is granted.
