TP/4839/2024 (E-filing) Ms. Gulestan Dubash, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioners namely Ajit Damodarankutty Nair and Seema Ajit Nair being Executors named under the Will of deceased. The deceased namely Perumbidi Padmavathy Kaimal died at Mumbai on 12.09.2023. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.

2. The deceased left behind her last Will and Testament which was duly executed at Mumbai on 03.10.2018 and 20.09.2019. Ld. Advocate for petitioner submits that the same is registered on 04.06.2019 before the SubRegistrar, Kurla. The said Will is in English language. The Para No. 1 of the Will refers to the appointment of Executor. Only two Executors appointed under the Will who are petitioners herein.

3. Ld. Advocate for petitioner submits that as per Will deceased was a widow. As per para No. 7 of the petition, deceased was survived by one son and one daughter who have given their consents in favour of the petitioner. Consent Affidavits are on record. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavits of Nettath Sreedharan Nair and Ambujakshi Sreedharan Nair dated 13.10.2023 one of the Attesting Witnesses to the Will are filed. Affidavit of Service of General Citation dated 19.11.2024 is filed. All other legal formalities are complied with. Hence, petition is granted.
