TP/4840/2024 (E-filing) Mr. Navin P. Sachanandani, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Ramakrishnan Narayanan being one of the Executors named under the Will of deceased. The deceased namely Sitalakshmi Subramanian said to have died at Mumbai on 13.09.2022. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.

2. The deceased left behind her last Will and Testament which was duly executed at Mumbai on 07.09.2013. The said Will is in English language. The Para No. 9 of the Will refers to the appointment of Executor. Only two Executor appointed under the Will. Petitioner is one of the Executors and another executor namely Gopal V. Iyer has renounced his rights as and Executor and has given full consent in favour of petitioner by an Affidavit dated 25.09.2023.

3. Ld. Advocate for petitioner submits that parents, husband and daughter of deceased predeceased the deceased. Daughter of deceased Kashma Narayan alias Kashma Iyer died on 25.08.2010, leaving behind one married daughter namely Shruta Narayan. She has filed her consent Affidavit in favour of the petitioner. Consent Affidavit is on record. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Rajalakshmi Pradip Sahadevan dated 25.09.2023 one of the Attesting Witness to the Will is filed. Affidavit of Service of General Citation dated 24.10.2024 is filed. All other legal formalities are complied with. Hence, petition is granted.
