Petitioner to explain the capacity of the petitioner to present the petition. 2.
Petitioner to state about marital status of the deceased. 3.
Petitioner to point out what property is bequeathed to the petitioner under the Will and thus he is a legatee of the said Will, 4.
The petitioner to file affidavit of the attesting witness/s in prescribe form No. 102 of the the Bombay High Court (OS) Rules, 1980. 5.
The petitioner to file an affidavit of the attesting witness regarding the addition/deletion/inter-lineation, etc. in the Will vide Rule 383 read with note provided at the foot of form No. 102 of the Bombay High Court (OS) Rules, 1980. 6.
The petitioner to execute the Administration Bond for the gross amount in view of Rule 420 in form No. 118 of the Bombay High Court (OS) Rules, 1980. 7.
Petitioner to give the list of the legatees/beneficiaries, who is/are entitled for the legacy under the Will. The petitioner to take steps to justify the surety to Administration Bond, in respect of the share of non-consenting legatees under the Will of the deceased, vide Rule 422 of the Bombay High Court (OS) Rules, 1980. Hence, the petition is adjourned for the steps.
