TP/4904/2024 (E-filing) Mr. Jyoti Badgujar i/b. Lakdawala and Co., Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Succession Certificate in respect of certain securities belonging to deceased filed by petitioner namely Pankaj Girijashanker Shukla being son of deceased. Deceased namely Girijashanker Manishanker Shukla died intestate at Mumbai on 30.11.1982. Copy of death certificate is annexed to the petition. Petitioner has filed Affidavit dated 09.07.2024 for non-availability of identification proof of deceased. The same is accepted.

2. Ld. Advocate for petitioner submits that mother of deceased predeceased the deceased. Widow of deceased since deceased the deceased. As per para No. 4 of the petition, deceased was survived by two daughters, one son, three grandsons, one daughter-in-law, two granddaughters, one granddaughter-in-law and one great-grandson. Out of them one son is petitioner herein and except one granddaughter-in-law namely Sujata and one great grandson namely Vivek, all other legal heirs have given their consents in favour of petitioner herein. Consent Affidavits are on record. As regards the Sujata and Vivek, the petitoner had filed Interim Application (L) No. 32575 of 2025 for dispensation of justification of surety and By an order dated 10.10.

2025 the Hon'ble Court has allowed the said Interim Application in terms of prayer clause (a) and (b) thereby has dispensed with the justification of surety of the said Sujata and Vivek. The said Sujata and Vivek have been served with the citation through the office of Sheriff, Mumbai and Affidavit of Service dated 20.06.2025 is filed to that effect. There are no other legal heirs.

3. Petitioner's oath is filed. Affidavit of Service of affixation of General Notice dated 25.10.2024 and Administration Bond dated 21.06.2025 are filed. Delay is explained and same is condoned. All other legal formalities are complied with. Hence, petition is granted.

4. Office to issue Succession Certificate as prayed after verifying whether any cross petition is filed or whether any Affidavit opposing grant is filed. 18.11.2025 COMPANY REGISTRAR / TESTAMENTARY REGISTRAR
