TP/4928/2024 (E-filing) Mr. D. P. Desai, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioners namely Prakash Devidas Shah, Amit Pravinchandra Bhansali and Vinod Waman Shere being Executors named under the Will of deceased. The deceased namely Rasiklal Tribhovandas Bhansali died at Mumbai on 27.12.2020. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copies of Aadhaar Card and Pancard are annexed to the petition.

2. The deceased left behind his last Will and Testament which was duly executed at Mumbai on 04.06.2013. The said Will is in English language. The Para No. 1 of the Will refers to the appointment of Executors. Only three Executors appointed under the Will who are petitioners herein.

3. Ld. Advocate for petitioner submits that parents and wife of deceased predeceased the deceased. Ld. Advocate to properly specify the relations of legal heirs of deceased and specify correctly class I and Class II legal heirs of deceased.

4. Petitioner's oath is filed. Affidavit of Ramchandra S. Parab and Mangesh S. Parab dated 04.11.2023 both the Attesting Witnesses to the Will are filed. Affidavit of Service of General Citation dated 07.02.2025 is filed.

5. Ld. Advocate of petitioner seeks leave to amend the para Nos. 9 and 10 of the petition. Leave is granted. Ld. Advocate for petitioner to carry out amendment within twelve weeks from the date of uploading of this order. Ld. Advocate for petitioner re-upload the amended petition on the official portal of the Bombay High Court.
