TP/4928/2024 (E-filing) WITH WILL/1964/2024 Mr. D. P. Desai, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioners namely Prakash Devidas Shah, Amit Pravinchandra Bhansali and Vinod Waman Shere being Executors named under the Will of deceased. The deceased namely Rasiklal Tribhovandas Bhansali died at Mumbai on 27.12.2020. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copies of Aadhaar Card and Pancard are annexed to the petition.

2. The deceased left behind his last Will and Testament which was duly executed at Mumbai on 04.06.2013. The said Will is in English language. The Para No. 1 of the Will refers to the appointment of Executors. Only three Executors appointed under the Will who are petitioners herein.

3. Ld. Advocate for petitioner submits that parents and wife of the deceased predeceased the deceased. Deceased died issue-less. Deceased had seven brothers and three sisters. Ld. Advocate for petitioner states that out of them two brothers namely Pravinchandra and Narendra predeceased the deceased and one sister namely Subhadra predeceased the deceased. One brother of deceased namely Prabhudas died on 30.12.2021 leaving behind two daughters. Therefore, deceased was survived by four brothers (Ashwin, Chandrakant, Shantilal, Jagdish) and two sisters (Bhanuben J. Shah and Sarla Topiwala) and two nieces (Smita and Bindu), who all have given their consents in favour of petitioner herein. Consent Affidavits are on record. There ae no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Ramchandra S. Parab and Mangesh S. Parab dated 04.11.2023 both the Attesting Witnesses to the Will are filed. Affidavit of Service of General Citation dated 07.02.2025 is filed. All other legal formalities are complied with. Hence, petition is granted.

5. Office to issue Probate as prayed after verifying whether any cross petition is filed or whether any caveat is filed.
