1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Feroze Rustom Soonawala and Kamal Neville Tata both being Executors named under the Will of deceased. The deceased namely Freddie Jehangir Gimi is said to have died at Mumbai on 12.03.2024. Copy of the death certificate is annexed to the petition. Identification proof of deceased viz. a copy of the Aadhaar Card is annexed to the petition.

2. The deceased left behind his last Will and Testament which was duly executed at Mumbai on 04.03.2019. The said Will is in English language. The Para No. 1 of the Will refers to the appointment of Executor. Only two Executors appointed under the Will who both are petitioners herein.

3. Ld. Advocate for petitioner submits that deceased died as bachelor. parents of the deceased predeceased the deceased. Deceased had no brother and had only one sister namely Piloo Rustom Soonawala who died on 30.04.2013 leaving behind her husband, two sons and two daughters. Out of them one son and one daughter are petitioners herein and all other legal heirs have given their consents in favour of the petitioner. Consent Affidavits are on record. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Noshir Jahangir Sethana dated 04.09.2024 one of the Attesting Witness to the Will is filed. Affidavit of Service of General Citation dated 17.02.2025 is filed. All other legal formalities are complied with. Hence, this Petition is granted.
