TP/4959/2024 (E-filing) Mr. Rakesh K. L. Kapoor, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of photocopy of last Will and Testament of deceased filed by petitioner namely Ramesh Nandkishor Khanna being sole Executor named under the Will of deceased. The deceased namely Shiraz Cyrus Vesavevala died at Paris, France on 02.07.2022 Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.

2. The deceased left behind his last Will and Testament which was duly executed at Mumbai on 30.07.2019. The said Will is in English language. The Para No. 2 of the Will refers to the appointment of Executor. Only one Executor appointed under the Will.

3. Ld. Advocate for petitioner submits that parents of deceased predeceased the deceased. Deceased was survived by widow and two minor daughters. Out of them widow has filed consent in favour of petitioner herein for herself and on behalf of two minor daughters as mother and natural guardian. Consent Affidavits are on record. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Shalini Khanna dated 12.11.2022 and Shriram Narayan dated 11.11.2022 both the Attesting Witness to the Will are filed. Affidavit of Service of General Citation dated 02.12.2024 is filed. All other legal formalities are complied with. Hence, petition is granted.
