TP/4986/2024 (E-filing) Mr. Nikhil Waghmare i/b. Pirani and Co., Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Succession Certificate in respect of certain securities belonging to deceased filed by petitioners namely Dionysia Lourdes Mavis Coutinho and Edward Mnedes being daughter and son of deceased respectively. Deceased namely Joseph Linus Edward Mendes died intestate at Mumbai on 23.03.2010. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Pancard is already annexed to the petition.

2. Ld. Advocate for petitioner submits that wife of deceased died on 02.02.2022. Deceased was survived by one daughter and one son who are petitioners herein. There are no other legal heirs.

3. Petitioner's oath is filed. Affidavit of Service of affixation of General Notice dated 19.12.2024 is filed. As all surviving legal heirs of the deceased are petitioners before this Court and the right or interest of no other legal heir is required to be protected. Hence, Administration Bond is dispensed with. Delay is explained and same is condoned. All other legal formalities are complied with. Hence, petition is granted.
