Mr. Velar, Learned Counsel for the Petitioner seeks leave to withdraw the Testamentary Petition submitting that the Petitioner would have to file a separate Testamentary Petition based on an authenticated copy of the Will since the probate in respect of the Will in question is already granted by the Courts in the United Kingdom.

He thus seeks leave to withdraw with a liberty to adjust the Court fees paid in the present Testamentary Petition to the Court fees as may be payable in the fresh Testamentary Petition to be filed. 3.

Hence, the captioned Testamentary Petition is withdrawn with the aforesaid liberty granted.
