TP/5016/2024 (E-filing) Pravin Kadam, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Succession Certificate in respect of certain securities belonging to deceased filed by petitioner namely Archana Vijaykumar Bhalla being daughter of both the deceased. Deceased No. 1 namely Shashi Porus Munsif died intestate at Surat on 12.08.1989. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Passport is already annexed to the petition. Deceased No. 2 namely Porus Mangaldas Munsif died intestate at Surat on 18.07.1982. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Passport is already annexed to the petition.

2. Ld. Advocate for petitioner submits that parents of deceased predeceased the deceased. Deceased were husband and wife and they were survived by one daughter and one son. Out of them daughter is petitioner herein and son has given his consent in favour of petitioner. Consent Affidavits are on record. There are no other legal heirs.

3. Petitioner's oath is filed. Affidavit of Service of affixation of General Notice dated 20.01.2025 and Administration Bond dated 08.01.2025 are filed. Delay is explained and same is condoned.

4. Petition is filed jointly for the estate of deceased No. 1 and 2. Para No. 8 of the petition states that shares are held jointly by both the deceased. Upon perusal schedule I annexed to the petition, it is noticed that the items at Sr. Nos. 10 and 11 are the only items held by both the deceased jointly. Items at Sr. No. 1 to 9 are held by deceased No. 1 only. Hence, petitioner is required to pay court fees for the estate of deceased No.1 as per section 23 of the Maharashtra Court Fees Act, 1959. As it is separate estate of deceased No.1. However, Advocate to take steps.

5. Ld. Advocate for petitioner file praecipe to place on board as and when the matter is ready for final grant. Hence, remove from board. 30.06.2025 COMPANY REGISTRAR / TESTAMENTARY REGISTRAR
