TP/5068/2024 (E-filing) Mr. Sushil Inamdar i/b. Ajit Shrikhande, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament alongwith Codicil of deceased filed by petitioner namely Pauravi Gautam Desai being widow of deceased and sole Executrix named under the Will of deceased. Deceased namely Gautam Vasanvihari Desai alias Gautam V. Desai said to have died at U.S.A. on 16.01.2024. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.

2. Ld. Advocate for petitioner submits that deceased left behind his last Will and Testament which was duly executed at Mumbai on 08.10.2000 and Codicil was duly executed on 20.05.2015. The said Will and Codicil are in English language.

3. Ld. Advocate for petitioner submits that mother of deceased predeceased the deceased. Deceased was survived by widow, one son and one daughter. Out of them widow is petitioner herein and all other legal heirs have given their consents in favour of the petitioner. Consent Affidavits are on record. There are no other legal heirs.

4. Petitioner's oath is filed. Two Affidavits of Sadhana S. Parekh both dated 20.06.2024 one of the Attesting Witness to the Will as well as Codicil are filed. Affidavit of Service of General Citation dated 02.12.2024 is filed. All other legal formalities are complied with. Hence, petition is granted.
