TP/5108/2024 (E-filing) Mr. Tejjas P. Shah, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Ramniklal Bhanji Shah and Rahul Ramesh Chheda being Executors named under the Will of deceased. The deceased namely Laxmichand Bhanji Shah died at Mumbai on 17.03.2024. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.

2. The deceased left behind his last Will and Testament which was duly executed at Mumbai on 24.11.2019. The said Will is in Gujarati language and translation of the said Will is filed however, Affidavit of Advocate for petitioner for certifying true and correct translation of the Will is not filed. At the end of the Will, it refers to the appointment of Executors. Only two Executors appointed under the Will.

3. Ld. Advocate for petitioner submits that parents and wife of deceased predeceased the deceased. Deceased was survived by three daughters who all have given their consents in favour of the petitioner. Consent Affidavits are on record. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Kamlesh T. Sakrani dated 08.10.2024 one of the Attesting Witness to the Will is filed. Affidavit of Service of General Citation dated 21.06.2025 is filed.

5. Ld. Advocate for petitioner file praecipe to place on board as and when all compliance is done in this matter.
