TP/5109/2024 (E-filing) Ms. Shobhana Waghmare, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Yunus Dawood Bhoraniya being sole Executor named under the Will of deceased. Deceased namely Pradeep Jamnadas Raichandani said to have died at Mumbai on 20.11.2004. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Election Card is annexed to the petition.

2. Ld. Advocate for petitioner submits that deceased left behind his last Will and Testament which was duly executed at Mumbai on 09.01.2003. The said Will is in English language.

3. Ld. Advocate for petitioner submits that in para No. 10 of the petition as mentioned by the petitioner that he is not aware of any legal heirs of deceased therefore, they have take steps for newspapers publication and Affidavit of Service of publication dated 02.01.2025 is filed to that effect. There are no other legal heirs.

4. Petitioner's oath is filed. Joint Affidavit of Muhammad Yassen Yusuf Sunsasra and Imran Ahmed Nedariya dated 23.08.2024 both the Attesting Witnesses to the Will is filed. Affidavit of Service of General Citation dated 12.12.2024 is filed. All other legal formalities are complied with. Hence, petition is granted.
