TP/5110/2024 (E-filing) Mr. Malcolm Vaz i/b. Sanjay Rego, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Anil Parsram Advani being sole surviving Executor named under the Will of deceased. The deceased namely Savitri Parsram Advani died at Mumbai on 16.02.2004. Copy of death certificate is annexed to the petition. Petitioner has filed Affidavit dated 15.06.2024 since, identification proof of deceased is not available. The same is accepted.

2. The deceased left behind her last Will and Testament which was duly executed at Mumbai on 25.02.1989. The said Will is in English language. The Para No. 2 of the Will refers to the appointment of husband of deceased as first executor and failing him the son will be the Executor. Ld. Advocate for petitioner submits that husband of deceased died but death certificate is not annexed to the petition. Hence, petitioner is sole surviving executor appointed under the Will.

3. Ld. Advocate for petitioner submits that parents and husband (death certificate is not annexed) of deceased predeceased the deceased. Deceased was survived by one son only who is petitioner herein. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of the Attesting Witness to the Will is not filed. Affidavit of Service of General Citation dated 12.12.2024 is filed.

5. Ld. Advocate for petitioner file praecipe to place on board as and when the matter is ready for final grant.
